The insured persons :
A number of terms are used frequently in our insurance policies. The list below contains the meaning that shall be given to these terms.
Definition of the parties to the policy
The Insured :the Policyholder and the beneficiaries of the ordered tickets, whose tax and legal domicile is located in the European Union.
Order : a ticket booking, formalised in the insurance certificate that contains the purchase date, information about the show (name, place, date, day and time). If the insurance cover has been taken out, the order will contain a specific billing line, but without naming the beneficiaries.
We/us : Mondial Assistance International, i.e. the insurer with which you have taken out your insurance policy, hereinafter referred to as MAI.
Policyholder: the signatory of the Specific Terms and Conditions, who thereby undertakes to pay the insurance premium.
You : the insured person or persons.
Definition of insurance terms
Natural disaster : event caused by the abnormal intensity of a natural agent.
Foreign/abroad : any country except for the country where you are resident or of which you are a citizen, France and French overseas departments.
Europe : The European Union (including the following French overseas territorial communities: Réunion, Martinique, Guadeloupe and Guyana) and Switzerland.
France : Metropolitan France (including Corsica), the Principalities of Monaco and Andorra.
Excess : the share in the loss payable by yourself when the claim is settled. Excess amounts in respect of each type of cover are specified in the cover and excess amounts table.
Temporary disability : loss, for a limited period of time, of a person’s functional capacity, which, on the day of the cancellation, obliges them to cease all activity, including professional activity if applicable, and which gives rise to a diagnosis and care by a doctor with accompanying medical treatment.
Time limitation : period beyond which any claim is time-barred.
Claim : all damaging consequences of an event falling within the scope of one of the types of cover taken out. All damages arising from the same initial cause constitute one and the same claim.
Show : any entertainment, cultural or sports event.
Subrogation : process by which we replace you in respect of your rights and legal actions against any party liable for your damages, in order to obtain repayment of the sums we have paid you following a claim.
Third party : any natural person or legal entity, except:
Cover applies to the show ticket purchased from a ticket agency as mentioned on the ticket, and which takes place in the European Union.
In addition to the specific exclusions stated for each type of cover, we never insure
the consequences of the following circumstances and events:
1. civil or foreign wars, riots, popular movements, strikes, hostage taking, handling of weapons;
2. your voluntary participation in bets, crimes or fights, except in a case of legitimate defence;
3. any effects of a nuclear origin or caused by any source of ionizing radiation;
4. your intentional acts and fraudulent faults, including suicide and attempted suicide;
5. your consumption of alcohol, drugs or any stupefying substance listed in the French Public Health Code, not medically prescribed.
Cancellation
1. Purpose of the cover
We reimburse you up to the amount limits stated in the cover and excess amounts table, for the amount of the insured show ticket, if you are unable to attend the show as a result of the occurrence of a covered event.
We are only able to provide insurance cover for tickets for a show with a fixed performance date.
2. Events covered in relation to a cancellation
Cancellation, after insurance has been taken out, must be the result of one of the following events, which absolutely prevents you from attending the show.
2.1. Temporary or permanent disability of:
Directly resulting:
If you cannot establish the true nature of this incapacity or if the information
provided does not prove the materiality of the facts we can reject your claim.
2.2. The death of:
absolutely requiring you to be present on the scheduled day of the show to
implement conservation measures and administrative actions.
2.4. If your employer informs you that your presence is essential on the day and time of the show and the employer’s notification being known and declared over 72 hours before the show.
2.5. Serious damage to your vehicle occurring in the 4 hours prior to the show, insofar as the vehicle can no longer be used for you to get to the show venue.
2.6. The birth of a child within the 48 hours prior to the show.
2.7. A generalised public transport strike.
2.8. Your unforeseen, mandatory summons to appear in court, as a witness or for jury service, that cannot be postponed.
2.9. Your notification of a resit examination in connection with higher studies, on the day of the show or the following day, provided that the examination failure was not known at the time when you took out this policy.
2.10. Theft of the ticket for the show, in connection with an attack or a home or vehicle break-in.
2.11. Loss or theft of your identity documents (passport, identity card) that you need to attend the show, provided that the loss occurs after the booking has been made and less than two months before the show. You must have reported the crime at the time when the documents were lost.
2.12. Cancellation for one of the events mentioned above (Articles 2.1 to 2.11), by one or more of the persons who booked at the same time as you and who are covered by this policy if, as a result of their withdrawal, you are obliged to attend the show alone.
3. Amount covered
We reimburse you up to the amount limits stated in the cover and excess amounts table, for the amount of the insured show ticket.
4. Cover exclusions
In addition to the exclusions that are common to all types of cover, the consequences
of the following circumstances and events are also excluded:
4.1. illnesses already diagnosed or accidents that had already occurred, or treatment or relapse or deterioration or hospitalisation between the date on which the show was booked and the date on which this policy was taken out;
4.2. unstabilised illnesses or injuries that were diagnosed or treated during the 30 days prior to your show booking;
4.3. pregnancy complications, beyond the 28th week, and in all cases, voluntary termination of pregnancy, in vitro fertilisation;
4.4. epidemics, local health situations, pollution, meteorological or climate events;
4.5. natural disasters occurring abroad, definitely caused by the abnormal intensity of a natural agent and those natural disasters referred to in Law N° 82-600 of 13 July 1982;
4.6. criminal proceedings against you;
4.7. cancellation of the show by the organiser;
4.8. cancellation of the show as the result of an administrative or legal decision.
5. What you must do in the event of cancellation
You must advise us of the claim within five working days of your knowledge of the event, except in the case of exceptional circumstances or force majeure:
If you fail to meet this deadline and we incur a loss because of your late notification,
you lose all rights to compensation.
We will provide you with the information needed to make your claim statement and you will be required to supply us with all documents and information to serve as proof of the reason that you are unable to attend the show, which will enable us to assess the amount of compensation due to you.
In any event, you must return the original show ticket to us.
If the reason for your cancellation is medical, if you wish, you may send the medical details in an envelope marked «Confidential» for the attention of the MAI medical expert (Médecin conseil).
1. Procedures for taking out cover, when it takes effect and its termination
Insurance must be taken out on the same day as the ticket is booked.
Cover is effective immediately, subject to the premium being paid.
Cover terminates at the start of the show.
Cooling-off: When tickets are purchased on the web site, the Insured person has 14 days following the date on which the tickets were purchased to withdraw from the insurance and to be repaid in full for the amount paid, provided that the Insured person has not made a claim to Mondial Assistance International in the intervening period.
2. Cumulative insurance
If you are covered for the same risks with other insurance companies, you must inform us of this and provide us with their details and the scope of their cover, in accordance with Article L 121-4 of the French insurance code.
You can obtain compensation for your loss by contacting the insurance company of your choice.
3. Subrogation in your rights and actions
In consideration for the payment of compensation and, up to its limit amount, webecome beneficiaries of the rights and actions that you owned against anyone liable for the claim, in accordance with Article L 121-12 of the French insurance code.
If, by your act, we are no longer able to perform this action, we can be discharged of all or part of our obligations towards you.
4. Penalties applicable if you make a false statement when taking out the policy
Any non-disclosure or false statement, any omission or inaccuracy in the statement of the risk is penalised under the terms and conditions stated in Articles L 113-8 and L 113-9 of the French Insurance Code:
5. Penalties applicable if you make an intentionally false statement at the time of the claim
Any fraud, non-disclosure or intentional false statement by you about the circumstances or consequences of an incident will result in the loss of all entitlement to services or compensation for this incident.
6. Time limitation
Any legal action arising from the insurance policy is subject to a time limitation period of 2 years from the event which gives rise it, under the conditions established by Articles L 114-1 and L 114-2 of the French insurance code.
The time limitation period is interrupted mainly by the despatch of a registered letter with acknowledgement of receipt by our company to the insured person in respect of legal action for payment of the premium or by the insured person to our company in respect of payment of the compensation or by the appointment of an expert as the result of a claim.
7. Loss assessment
The causes and consequences of the claim are assessed by mutual agreement and failing this, by jointly agreed loss assessment, subject to our respective rights.
Each of us appoints an expert. If the appointed experts do not agree, they appoint a third expert: the three experts work in common on a majority vote basis.
If one of us fails to appoint their expert or the two experts are unable to agree on the selection of the third expert, the appointment shall be made by the Presiding Judge of the Tribunal de Grande Instance of the place where the policyholder is domiciled.
This appointment shall be made on a written request signed by both parties or by just one party, the other party having being summoned by registered letter.
Each party pays the fees and expenses of their own expert and half of the fees of the third expert, if appointed.
8. Claim settlement time period
As soon as your case is complete, compensation will be paid within 10 days following the agreement between us or an enforceable court ruling.

If you still disagree, after you have received the response from our company, you can request an opinion from an arbitrator.
Procedures for access to the arbitrator will be sent to you if you write to the address above.

Any disputes raised against MAI concerning this policy, shall be exclusively submitted to the competent French courts and all notices should be sent to the address shown above.
11. Law on information technology and freedom
In accordance with the French Law on Information Technology and Freedom No. 78-17 of 6 January 1978, as amended by Law No. 2004-801 of 6 August 2004, you have the right to access, change, correct or remove any information about yourself that is contained in our files, by contacting our registered office in France.

The body responsible for the regulation of MAI is the Autorité de contrôle des assurances et des mutuelles (French insurance industry regulatory authority), 61 rue Taitbout, 75436 Paris Cedex 09.
